Terms of Service

The fine print, written so you can actually read it. Each section starts with a plain-English summary. The summaries help you understand; the full text is what governs.

Effective date

01

The agreement

Plain English: Buying or using our services means you agree to these terms.

These Terms of Service ("Terms") are a binding agreement between Kingdom Performance Group, LLC, doing business as Anvil Rise ("Anvil Rise," "we," "us") and you, the person or organization using our Services ("you," "Client"). By purchasing, accessing, or using any of our Services, or by accepting an order form or service agreement that references these Terms, you confirm you have read, understood, and agree to these Terms and our Privacy Policy.

Heads up: Section 20 contains an arbitration agreement and class action waiver, with a 30-day opt-out. Read it.

02

Definitions

Services means the website strategy, design, build, hosting, maintenance, local visibility work, review tools, optional guest follow-up, integrations, and other work identified in your proposal, order form, or service agreement. Client Content means the text, images, logos, organizational information, contact lists, inquiries, reviews, and other materials you provide or that are collected on your behalf. Order Form means the proposal, statement of work, service agreement, or other written ordering document accepted by both parties. Subscription means any recurring payment arrangement stated in an Order Form.

03

Eligibility and your account

You must be at least 18, able to enter a binding contract, and acting for a lawful organization. Keep your account information accurate and current. You are responsible for activity under your account, including by your employees, volunteers, and contractors.

04

The services

Plain English: Your written proposal defines the scope. The website foundation is built around a clearer first welcome.

We provide website and digital-welcome services for churches and other ministry organizations. Unless your Order Form says otherwise, the core Church Website & Welcome Foundation includes:

  • Website strategy, design, and build for up to 10 primary pages.
  • Mobile-first layouts and clear first-visit pathways.
  • Google Business Profile and local search fundamentals.
  • An ethical review request path, monitoring, and response guidance.
  • Managed hosting, maintenance, monitoring, and practical content updates.

Additional migration, multiple locations, guest follow-up, custom integrations, advertising, social media management, advanced AI agents, voice AI, full church-system migrations, and extensive ministry automation are not included unless an Order Form says they are. We will quote work outside the agreed scope before it begins.

We may improve, add, or retire features over time. We will not materially reduce the core functionality of an active recurring plan without notice.

05

Plans and pricing

Plain English: You’ll see the scope and price before you agree to the work.

Your scope, fees, billing schedule, initial term, renewal terms, and any included or additional services are stated in your Order Form. Additional services are scoped and priced in writing before work begins. We may change the price of a renewing service with at least 30 days’ notice, effective no earlier than your next renewal period.

06

Billing, renewal, and payment

Fees are billed according to your Order Form. Recurring fees renew automatically at the then-current rate until canceled under section 11. Payments are processed by Stripe. By providing a payment method you authorize charges for agreed fees, applicable usage charges, and taxes. Fees exclude taxes; you are responsible for taxes that apply other than taxes on our income.

We do not charge fees that are not stated in your Order Form or separately accepted by you in writing. Work outside the agreed scope requires written approval before it is billed.

07

Usage-based communications charges

Plain English: If you add metered communications, you’ll see the rates and billing mechanics before they’re turned on.

Certain optional communications services, including phone numbers, SMS and MMS messaging, voice calls, number-intelligence functions, carrier charges, and regulatory messaging fees, may be charged separately based on use. Your initial rates and any prepaid-wallet mechanics will be stated in a schedule or Order Form you receive before those services are enabled. Only categories disclosed there or later accepted under this section may be charged.

Usage may post after the underlying call, message, or function occurs. If a required wallet is depleted or an automatic payment fails, we or the platform provider may interrupt the affected metered services until sufficient funds are added. You remain responsible for usage incurred before interruption, including charges posted later.

We will give at least 30 days’ notice before changing an Anvil Rise-set rate or adding a new billable category. Carrier, regulatory, campaign, tax, and other third-party pass-through charges may change when the provider changes them and will be billed at the then-current disclosed amount. We will notify you of a material third-party change as soon as reasonably practicable. No change applies retroactively to usage completed before its effective date.

08

Refunds and chargebacks

Plain English: Custom work begins quickly. If something’s wrong, contact us so we can address it directly.

Unless an Order Form or applicable law says otherwise, payments are final and non-refundable once the corresponding custom work or service period has begun. You agree not to initiate a chargeback for services properly rendered. If you believe a charge is wrong, contact billing@anvilrise.com first and we will work to resolve it. We reserve the right to contest improper chargebacks with delivery documentation and to recover associated costs where permitted.

Consumed usage, carrier charges, regulatory fees, and complimentary credits are non-refundable. After termination, unused purchased wallet credits will be handled according to the applicable Order Form and law. Complimentary credits have no cash value.

09

Service delivery

The expected timeline, milestones, and deliverables are stated in your Order Form. Unless that document says otherwise, our target is to launch the initial website within two to three weeks after we receive the required content, account access, decisions, and approvals. Client-caused delays may move the launch date and do not automatically move agreed billing dates.

You will have the opportunity to review the work before launch. Reasonable revisions within the agreed scope are included during the build. Major scope changes, additional pages, or a redesign requested after approval are quoted separately before work begins.

10

Payment failures and suspension

If a payment fails, we may retry it and give you a reasonable opportunity to correct the payment method. We may suspend affected Services while an overdue balance remains unpaid. A failed payment for optional metered services may interrupt those services before the rest of the account is suspended. Suspension does not cancel amounts already owed.

11

Cancellation

Plain English: The cancellation terms in your proposal control. Recurring services end at the close of the paid period unless we agree otherwise.

You may cancel a recurring service by contacting support. Unless your Order Form says otherwise, cancellation takes effect at the end of the current billing period, and you will not be charged after that. Cancellation does not refund prepaid amounts or fees for work already performed. Automatic wallet refills stop when termination becomes effective. Usage incurred before termination may post afterward.

12

Who owns what

Plain English: Your domain, content, contact lists, inquiries, and reviews are yours. The Order Form explains what happens to the website build and licensed tools.

12.1 Yours, always

You own your Client Content: your text, images, logos, organizational information, contact lists, inquiries, and reviews. If you registered your domain through us, it is yours, and we will transfer the registration to you on request, subject to payment of undisputed amounts owed and registrar requirements. You grant us a non-exclusive license to host, store, display, and process Client Content only as needed to provide the Services.

12.2 Ours or licensed

Our software, reusable templates, automations, methods, and underlying technology are owned by Anvil Rise or our licensors. Your Order Form will state whether the completed website build is transferred to you, licensed while you subscribe, or subject to another arrangement. Unless an Order Form expressly transfers an item, you receive a limited, non-exclusive, non-transferable license to use it for your organization while the applicable Service remains active.

12.3 Leaving

For 30 days after termination we will keep your Client Content reasonably available for export and assist with domain transfer. After 30 days we may delete or archive it. Export your data before then.

12.4 Feedback

If you send us ideas or suggestions, we can use them without restriction or obligation.

13

Acceptable use

You agree not to use the Services to: send spam or messages without legally required consent; violate the TCPA, CAN-SPAM, A2P 10DLC requirements, or applicable privacy laws; send unlawful, fraudulent, harassing, or defamatory content; promote illegal activity; reverse-engineer licensed technology; resell the Services without our written consent; build a competing product; circumvent security or technical limits; or upload malicious code. We may suspend or terminate accounts engaged in prohibited activity.

14

Your compliance obligations

Plain English: When your organization contacts people through the services, you’re the sender. Consent, opt-outs, and contact rules are your responsibility.

When you send SMS, MMS, voice, or email through the Services, you are the sender. You are responsible for obtaining valid consent where required, keeping proof of consent, honoring opt-outs promptly, including required disclosures, following applicable do-not-call rules, completing required messaging registration, and complying with privacy laws that apply to data you upload. For personal information you upload, you act as the controller or business and we act as the processor or service provider under our Data Processing Addendum. You represent that you have the right to upload and process that data.

14.1 Consent for every contact

For every contact reached through the Services, you represent and warrant that you have the level of consent or other lawful basis required for the specific channel, technology, content, and purpose of the communication. Before sending a marketing message using technology for which prior express written consent is required, you must hold a signed written or electronic consent that clearly identifies your organization as the sender, authorizes the applicable communications, and states that consent is not a condition of purchase.

14.2 Consent records

You must preserve auditable consent and revocation records, including the telephone number, date and time, source URL or paper source, available source data, the exact disclosure and checkbox version shown, the affirmative action taken, the communication purpose, and all opt-out events. You will provide the records to us within three business days after request. We may audit a campaign’s consent basis, block an upload or send, suppress a contact, or suspend messaging when records are absent or we reasonably believe the communication violates law or carrier rules.

14.3 Telemarketing rules

You are responsible for applicable federal and state do-not-call lists, calling-time rules based on the recipient’s local time, sender identification, required registrations, quiet hours, frequency limits, and state telemarketing laws. You must honor legally recognized revocation methods and must not re-add a suppressed contact without a new legally sufficient consent.

14.4 Review practices

Use review-request features only to seek honest feedback from people who had a genuine experience with your organization. You will not create or procure a fake or materially false review; ask insiders to review without clearly disclosing the relationship; offer an incentive conditioned on sentiment; select only people believed likely to leave a positive review; route satisfied people to a public review site while diverting others; prevent or discourage negative reviews; threaten or retaliate against a reviewer; falsely report a genuine negative review for removal; or imply displayed reviews represent all submitted reviews when reviews have been suppressed. You must comply with the applicable platform’s current policy even when it is stricter.

15

Term and termination

These Terms apply while we provide Services to you. We may suspend or terminate Services if you breach these Terms, fail to pay, create legal or regulatory risk for us, or if the law requires it. On termination, access ends as applicable, the export window in section 12.3 applies, and sections that by their nature survive, including ownership, indemnification, liability limits, disputes, and governing law, will survive.

16

Call recording

Plain English: Nobody gets recorded without being told at the start of the call and agreeing.

16.1 Anvil Rise calls

We may record or transcribe our sales, onboarding, and support calls only after giving notice at the beginning of the call. If you do not consent, tell us before the substantive conversation begins and we will continue without recording or use another communication method.

16.2 Calls made through the Services

You may not record or transcribe a call through the Services unless every participant receives a clear announcement, at the earliest practicable time and before the substantive conversation, that the call will be recorded or transcribed. You must obtain any consent required by the law of every relevant jurisdiction. Unless we approve another legally sufficient configuration in writing, you must obtain affirmative verbal or keypad consent from every participant before recording or transcription continues. If a participant declines, you must disable recording and transcription or end the call.

17

SMS terms

By opting in to messages from Anvil Rise you agree to receive service notifications, account messages, and occasional offers. Frequency varies. Message and data rates may apply. Reply STOP to opt out and HELP for help. We cannot guarantee delivery of any message; carrier networks are outside our control.

18

Disclaimers

Plain English: We promise professional work. Nobody can honestly guarantee attendance, inquiries, giving, or search rankings, so we don’t.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, AND WE DO NOT GUARANTEE SPECIFIC RESULTS, INCLUDING ATTENDANCE, INQUIRY VOLUME, GIVING, REVENUE, OR SEARCH RANKINGS.

19

Indemnification and limits on liability

You agree to defend and indemnify Anvil Rise and its officers, employees, and contractors against third-party claims arising from your use of the Services, your Client Content, communications sent through the Services, your processing of personal information, or your violation of these Terms or any law.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANVIL RISE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $100. THESE LIMITS ARE A FUNDAMENTAL PART OF THE BARGAIN. SOME JURISDICTIONS LIMIT THESE EXCLUSIONS; WHERE THEY DO, THESE LIMITS APPLY TO THE MAXIMUM EXTENT PERMITTED.

19.1 Your indemnity

You will defend, indemnify, and hold harmless Kingdom Performance Group, LLC, its affiliates, and their officers, employees, contractors, and agents from third-party claims, investigations, demands, penalties, carrier assessments, losses, judgments, settlements, and reasonable attorneys’ fees arising from or relating to your Client Content or contact lists; communications sent or initiated through the Services; absence, falsity, or inadequacy of consent records; violation of messaging, telemarketing, email, do-not-call, carrier, or privacy rules; unlawful call recording; unlawful review practices; or your violation of these Terms or law. We will give prompt notice when reasonably practicable and may participate with counsel of our choice at our expense. You may not settle a claim on our behalf without our written consent.

20

Disputes, arbitration, and class action waiver

Plain English: Small disputes go to small claims court. Bigger ones go to arbitration. You can opt out within 30 days.

20.1 Talk first

Before any formal action, both sides agree to try to resolve the dispute by emailing support@anvilrise.com with a description. If it is not resolved in 30 days, either side may proceed.

20.2 Arbitration above the small-claims limit

Except for a matter described in section 20.4, any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration under the Federal Arbitration Act. The arbitration will be administered by the American Arbitration Association under its Commercial Arbitration Rules and, where applicable, its Expedited Procedures, by one arbitrator. The legal seat is Atlanta, Georgia. The hearing will be conducted by videoconference unless the arbitrator determines that an in-person hearing is reasonably necessary.

20.3 Fees and remedies

The party initiating arbitration will pay the filing fee. The parties will share required administrative fees and arbitrator compensation equally, except that Anvil Rise will pay any amount applicable law requires it to pay. The arbitrator may reallocate fees and award any remedy available in court, including reasonable attorneys’ fees when authorized by contract or law. Each party otherwise bears its own attorneys’ fees and costs.

20.4 Small claims and limited carve-outs

Either party may bring an individual claim within a court’s small-claims jurisdiction in that court instead of arbitration, including Fulton County Magistrate Court when venue and jurisdiction are proper. Either party may elect small-claims court before an arbitrator is appointed. Either party may seek temporary or injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, data security, or unauthorized system access without waiving arbitration of the remaining claims.

20.5 No class proceedings

TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. The arbitrator may not combine claims of different persons or preside over a class or representative proceeding.

20.6 Opt-out

You may opt out of sections 20.2 through 20.5 by emailing support@anvilrise.com within 30 days after first accepting these Terms. The notice must include your name, organization name, account email, and an unambiguous statement that you opt out of arbitration. Opting out does not affect any other provision.

21

Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law rules. Any action not subject to arbitration must be brought in the state or federal courts located in Fulton County, Georgia.

22

The rest

Force majeure. Neither side is liable for delays caused by events beyond reasonable control, including carrier or third-party platform outages. Assignment. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale. Notices. We may notify you by email, in an account, or on our website; you may notify us at support@anvilrise.com. Changes. We may update these Terms with at least 30 days’ notice of material changes. Entire agreement. These Terms, the Privacy Policy, DPA, and each applicable Order Form are the whole agreement. If a provision is unenforceable, the rest stands. The parties are independent contractors.

Order of precedence. If there is a conflict, the following order applies: (1) your signed Order Form for client-specific commercial terms; (2) the Data Processing Addendum for data-protection matters; (3) these Terms; and (4) our published policies and service descriptions.

Changes to these Terms. We will not materially change the arbitration provisions, liability limits, data-use commitments, or the economics of a prepaid term solely by posting an update. For those changes we will give you direct notice and, where enforceability depends on it, obtain your affirmative acceptance. Other changes take effect on posting and continued use.
